Arizona homeowners could gain clearer permission to add commercially manufactured backyard shade structures, even where HOA rules currently restrict them on private lots.
The push began after an Arizona family installed a city-approved backyard gazebo, then removed it following an HOA dispute and court process.
A state lawmaker sponsored the measure, and one state legislative chamber passed it recently. It has now headed to the governor's desk for consideration.
Supporters frame backyard shade as practical in Arizona, helping families use outdoor spaces for meals, play, and relief during cooler seasons at home.
If approved by the governor, the bill would supersede HOA covenants for qualifying shade structures homeowners buy and install in their backyards.
